Chinese Culture University Regulations Governing Procurement and Management of Delicate and Expensive Instruments and Equipment(2018)

Article 1
“The Regulations Governing Procurement and Management of Delicate and Expensive Instruments and Equipment” (hereinafter referred to as “the present Regulations”) are prescribed by the Chinese Culture University (“the University”) for the purpose of consolidating the management, maintenance, servicing, and use effectiveness of delicate and expensive instruments and equipment of the University.
Article 2
For the purpose of the present Regulations, delicate and expensive instruments and equipment refer to any single piece or single set of instruments, equipment or musical instruments procured by a college at a price in excess of 1,000,000 NTD.
Article 3
Sources of funding of the University available to colleges for procurement of delicate and expensive instruments and equipment shall be divided into the following two categories:
1. Capital account funding of medium-term development plans of the University as appropriated to the colleges by the Accounting Office;
2. Individual-college or inter-college grants applied per the “Regulations Governing Incentive Grants for Colleges to develop Disciplinary Highlighted Features” of the University.
Article 4
For a college to use funding of the University in procuring delicate and expensive instruments and equipment, a procurement project proposal shall be furnished and submitted to the Office of Research and Development for compilation and submission and shall be reviewed as follows:
1. The procurement project proposal shall be reviewed by the College Affairs Council.
2. Upon approval by the College Affairs Council, the proposal shall be submitted to the Office of Research and Development for reexamination by the Delicate and Expensive Instruments and Equipment Procurement and Management Committee, for which non-affiliates of the University may be invited when necessary.
3. The principles for project review include the development of college/department features, interdisciplinary research, delicate and expensive instruments and equipment management regulations, and use effectiveness.
4. Upon approval by the Delicate and Expensive Instruments and Equipment Procurement and Management Committee, the project proposal shall be included in the medium-term development plan of the University and be submitted to the University Development Committee and the University Council for review and to the Board of Trustees for approval.
Article 5
The Office of Research and Development shall convene the Delicate and Expensive Instruments and Equipment Procurement and Management Committee, for which the President shall act as the chairperson while the Deans of the Colleges of Science, Agriculture, Engineering, Journalism and Mass Communication, Arts, and Environmental Design, Dean of Academic Affairs, Dean of Student Affairs, Dean of General Affairs, Dean of Research and Development, Director of the Accounting Office, and Director of the Center for Information and Communications shall be ex officio members, the Office of Research and Development shall be responsible for the relevant matters, and, when necessary, heads of other units, faculty and staff members, and non-affiliates of the University may be invited.
Article 6
The responsibilities of the Delicate and Expensive Instruments and Equipment Procurement and Management Committee are as follows:
1. Review of policies pertaining to procurement and management of delicate and expensive instruments and equipment.
2. Review of projects for procurement of delicate and expensive instruments and equipment.
3. Review of use, management, and fee regulations for delicate and expensive instruments and equipment.
4. Review of reports on use effectiveness of the delicate and expensive instruments and equipment.
5. Coordination of demands for various delicate and expensive instruments and equipment resources.
6. Other matters related to delicate and expensive instruments and equipment.
Article 7
Delicate and expensive instruments and equipment shall be managed collectively in principle and shall be placed at the colleges as projects require or at other on-campus locations as designated by the General Affairs Department.
Article 8
For individual-college or inter-college delicate and expensive instruments and equipment procurements, use, management, and fee regulations shall be established and, upon approval by the pertinent college(s), be submitted to the Office of Research and Development for reexamination by the Delicate and Expensive Instruments and Equipment Procurement and Management Committee.
Article 9
The following services shall be provided by any custodian unit of delicate and expensive instruments and equipment:
1. Management and maintenance of the delicate and expensive instruments and equipment.
2. Undertaking of various services such as measurement, forensic analysis, training, production analysis, technical support, and consultation as may be commissioned by affiliates and non-affiliates of the University.
3. Promotion of business-industry partnerships. Article 10 The Office of Research and Development shall establish and make public an inventory list of the delicate and expensive instruments and equipment of the University and the relevant regulations and shall accept use applications filed by affiliated/non-affiliated institutions or individuals so as to increase use efficiency and to increase business-education partnership revenues.
Article 11
Applications filed by affiliated/non-affiliated institutions or individuals for using the delicate and expensive instruments and equipment shall be received by the Office of Research and Development, while service shall be provided by the pertinent custodian unit upon approval by same. If service fees are involved, a receipt shall be issued by the Office of Research and Development. A custodian unit providing such service is allowed to submit a petition to the Office of Research and Development and the Accounting Office via an administrative petition process for provisions of necessary service expenditures, including supplies, personnel costs, and hourly fees for the period during which such service is provided. Ten percent (10%) of the revenues generated by providing such service shall be set aside as administrative management fees, which shall be distributed in accordance with the Regulations Governing Business-Education Partnerships of the University to be used by the colleges, graduate institutes, and departments as funding for procurement of books, instruments, equipment, and publications and as personnel costs for full-time and part-time contractual hiring; however, no provision of incentive rewards for full-time staff shall be allowed.
Article 12
For any project granted with funding for procurement of delicate and expensive instruments and equipment, either the pertinent College, project coordinator or one of the team members shall complete the following tasks in the subsequent year:
1. For procurements of delicate and expensive instruments and equipment with funding provided per the “Regulations Governing Incentive Grants for Colleges to develop Disciplinary Highlighted Features,” said Regulations shall govern.
2. For procurements of delicate and expensive instruments and equipment with grants provided capital account funding of medium-term development plan of the University appropriated to the Colleges, in the subsequent year, an application for a “thematic research project” shall be filed with the Ministry of Science and Technology, guidance shall be provided to students in applying for “College Student Research Projects,” and academic activities that comply with the Regulations Governing Incentive Rewards for Achievement in Academic Research of the University shall be carried out.
Article 13
For any project granted with funding for procurement of delicate and expensive instruments and equipment, the pertinent College, project coordinator or team members shall be barred from applying for any project grant of the University for two years upon failure to submit a research achievement report by the prescribed deadline, to complete any of the items prescribed in Article 12, and to provide supporting information pertaining thereto.
Article 14
The present Regulations and any amendment thereto shall be promulgated and implemented upon being adopted by the Academic Development Committee and the Administrative Council.
